What to do now to stay compliant on health and safety
In the last three years, there have been two new acts of parliament which have given Senior Directors pause for thought:
- The Health and Safety (Offences) Act 2008, in which imprisonment is now an option for a wider range of offences in both the lower and higher courts
- The Corporate Manslaughter (and Corporate Homicide) Act 2007 in which a company may be liable for unlimited fines and be subject to a publicity order.
With litigation on the increase, it could be said that a culture of extreme compliance with ever increasing red tape has arisen. The coalition government has styled itself as taking a more pragmatic view, with Lord Young's new agenda for health and safety.
Breakfast Meeting and Webinar - event details
We will be running two November events – a breakfast seminar and webinar – for senior directors who have strategic and budget responsibility for health and safety. The sessions will look at how the newly published Lord Young Report will impact the regulatory and political framework for health and safety, and explore the implications of this new agenda for Senior Directors; for example, what impact will it have on the risk of prosecution and civil liability claims and how can these risks be managed and controlled?
Our breakfast seminar speakers – Mark Tyler, an eminent health and safety lawyer and Ian Clements, a senior and experienced H&S consultant – will outline how health and safety regulation is changing, run a Q&A session and be on hand for answering specific queries. For the webinar discussion, they will be joined by Rachel Jones, an experienced senior health and safety manager.

Mark Tyler is a Solicitor and Chartered Safety and Health Practitioner, and a partner at Shook Hardy & Bacon International LLP in London (www.shb.com). He is recognised as a leading practitioner in the area of health and safety law in publications such as Legal 500 and Chamber UK.
Ian Clements is Managing Director of Quadriga Health and Safety (www.healthsafety.co.uk) and has extensive experience in advising Boards of Directors about Health and Safety. Quadriga provides specialist health and safety consultancy and training to a wide range of clients including Lloyd’s Register, Nuffield Health, Priory Healthcare and Virgin Media.
Rachel Jones is a Chartered Safety and Health Practitioner and the Head of Health, Safety and the Environment for the Automobile Association (www.theaa.com). Rachel has worked for the AA for the last 10 years and is active in promoting and supporting industry improvements in health and safety.
